When one is in the throes of a divorce, it may be challenging to remain amicable throughout the process. Then again you never thought you’d go from facing your spouse with adoring eyes as you exchange your vows on your wedding day to facing your soon-to-be former spouse giving one another the occasional abhorring glances, if at all, as your attorneys exchange your terms and demands during your divorce proceedings. On the other hand, it is possible to go through a smooth divorce procedure. As increasingly common as divorce has become in our society, with nearly 50% of couples dissolving their marriages, not every divorce is created equally. How the transition goes depends on several factors such as the number of assets and properties to be separated and whether there are children involved. Marriages with children must be handled with great sensitivity to avoid a child custody battle.
Because child support and visitation issues as well as splitting large assets such as one’s home or vehicle are major priorities to tackle, hiring an experienced attorney such as Mark McManus S.E. Ga. Law is in your best interest. Our firm has been working with clients in the Brunswick, Georgia area for more than 35 years. Specializing in divorce law, McManus recognizes how intricate each case is and therefore exceeds expectations when representing his clients. Finding the appropriate recourse, especially when children are in the picture, is what he does best. Having an understanding and professional attorney on your side is the way to go. Mark McManus is best known for working diligently on behalf of his clients and their families.
If you are looking for legal advice during a difficult time, Mark McManus S.E. Ga. Law is here to help. Call Mark at 912 289-9449.
For over two decades, Mark has worked with clients across the state of Georgia, including Brunswick, Georgia, representing clients in the 31520, 31527 and 31561 zip codes. Located on the southeast coast of Georgia, Brunswick is known for its Victorian-era Old Town Historic District. With causeways linking the city to the 4 barrier islands of the Golden Isles, tourists and residents alike can visit beautiful Sea Island, Fort Frederica National Monument in St. Simons Island, and St. Simons Lighthouse Museum.
Types of Divorce recognized in Georgia:
In the state of Georgia, when the court orders a final divorce, it means that the divorce is permanent. That is, the divorce is final which allows both parties to legally remarry. The divorce also terminates all property claims.
In Georgia, you can get a divorce if there is absolutely no chance in salvaging your marriage. This is referred to as "no-fault" divorce. Most divorces are granted if and when the marriage is "irretrievably broken." In such cases, it is not required to show any wrongdoing or fault.
In terms of an annulment, that is a declaration by a court that a marriage never existed. This is when it states it was never a valid marriage to begin with. It’s rare for courts to grant an annulment, so this isn’t always the best option if you are interested in dissolving your marriage.
Georgia also allows the filing or an action for separate maintenance (a legal separation). This includes all issues of a divorce, except that there is no divorce.
Even though divorce is more common today, many people aren’t familiar with all the legalities that surround it. Mark works with you one-on-one to make sure all your questions and concerns are answered and that you comprehend what each stage in the legal process entails. Painting a picture of your marriage and why divorce is what is best for you and your family will allow Mark to better strategize and executing an immediate plan so he can offer you sound legal advice. Knowing the law and any changes is what Mark is confident about, including guiding you through the process. Mark takes pride in being able to do this for his Kingsland clients while also taking some of the anxiety off them.
